At Leadmark, we respect your need for online privacy and protect any Personal Data, including but not limited to any ‘personal data’ defined in applicable data protection laws and regulations that you may share with us, in an appropriate manner. Our practice with respect to use of your Personal Data is as set forth below in this Privacy Statement. As a condition to the use of our services, you consent to the terms of the Privacy Statement as it may be updated from time to time.
What Personal Data do we collect and how will it be used
Leadmark collects Personal Data when you use our website(s) and when using our TRAC service. We collect Personal Data that you provide (such as names, mailing addresses, email addresses and telephone numbers) and Personal Data that are not directly entered such as IP addresses. We also may receive Personal Data at meetings, through emails or on telephone calls. We do not collect sensitive Personal Data, such as information relating to health, race, ethnicity, sexual orientation or personal financial data. We do not store credit card data. You may enter such data into the system of an independent credit card processor, but it is not accessible to or stored by Leadmark. Our services are not directed at people under the age of eighteen. We do not knowingly collect Personal Data from them and we request that they not provide us any Personal Data. We will erase any such data that is inadvertently provided or stored.
Leadmark will only collect, store, use or otherwise process your Personal Data for the following purposes: a) to prepare for or perform contracts for the sale of Leadmark’s goods or services; b) to provide the service you contracted with us; and c) to pursue our legitimate interests in marketing our goods or services, except where those interests are overridden by your interests or fundamental rights. We will retain your Personal Data only for the time needed to accomplish the purposes listed above.
Personal data and information sharing when using TRAC
Personal Data– During the Registration Process for creating a TRAC user account, you provide us with personally identifiable information such as name, email address, etc. This information is used primarily to identify you in our service, which is necessary for the login process. We will provide you with a unique username – based on your name (first & last name) – and an initial password – that you need to change with the initial logon – which enables you to login to the TRAC service. The username and password will be used solely for the purpose of providing access to the service. Your name and email address will be used for you to receive service announcements, administrative messages and changes in this Privacy Statement.
Leadmark will have access to third party Personal Data provided by you as part of using Leadmark Services such as user names, supplier contact information and contract data. This information may include third party names, email addresses, phone numbers and physical addresses and will be used only for servicing your requirements as expressed by you to Leadmark and solely as part and parcel of your use of the Service. We do not share this third party personal data with anyone for commercial or promotional purposes, nor do we utilize it for any purposes not expressly consented to by you.
From time to time we post testimonials and use cases on our website. These testimonials and use cases may include names and other Personal Information and we acquire permission from our users prior to posting these on our website. Leadmark is not responsible for the Personal Information users elect to post within their testimonials.
Usage details – When using TRAC your usage details such as time, frequency and the amount of storage used will be recorded by us in order to enhance your experience of the Services and to help us provide you the best possible service. Once you are logged in to the service you may enter basic personal identification and contact data of the people you work with, such such as name, title, company or organization, postal address, phone and fax numbers, etc. This information is only shared with the people you choose to share it with within the managed contract engagement. We do not share this information with anyone and do not use it for promotional or commercial purposes, nor do we sell or market this information to any third party.
Contents of your User Account – We store and maintain files, documents, to-do lists, emails and other data stored in your user account at our data center facilities in the Netherlands. In order to prevent loss of data due to errors or system failures, we also keep backup copies of data including the contents of your user account. Hence your files and data may remain on our servers even after deletion or termination of your user account. We may retain and use your Personal Data and data as necessary to comply with our legal obligations, resolve disputes, and enforce our rights. We assure you that the contents of your user account will not be disclosed to anyone and will not be accessible even to employees of Leadmark except in circumstances specifically mentioned in this Privacy Statement, the Terms of Services or in the Data Processing Addendum. We also do not use the contents of your user account for serving targeted advertisements or other commercial activities.
Payment information – In case of services requiring payment through our website or customer invoice portal, we request credit card or other payment account information depending on your preferred payment method. This information will be used solely for processing payments and to contact you in case that a problem should occur with your account. Your financial information will not be stored by us except for the name and bank account number and in case of payments through credit card the address of the card holder, the expiry date and the last four digits of the credit card number. Subject to your prior consent and where necessary for processing future payments, your financial information will be stored on servers of our reputed Payment Service Provider under strict terms in accordance with this Privacy Statement.

Some pages on our website contain external links. You are advised to verity the privacy practices of such other websites. We are not responsible for the manner of use or misuse of information made available by you at such other websites. We encourage you not to provide Personal Data, without assuring yourselves of the Privacy Statement of such other websites.
Cookies and other tracking technologies
Our TRAC service requires the use of cookies for the login procedure, so you cannot use the service if you set your browser to reject cookies. Cookies are also used for the duration you are logged in to store session information. By selecting ‘keep me signed-in’ option in TRAC, a permanent cookie will be stored on your computer and you will not be required to sign-in by providing complete login information each time you return to the Service. Leadmark will never use cookies to retrieve information from your computer that is not related to the services.
With whom we share information
We may need to share your Personal Data and your data with our service providers and business partners solely for the purpose of providing Leadmark Services to you. The purposes for which we may disclose your Personal Data to our service providers include, data storage, database management, system support and maintenance and payment processing. These service providers are authorized to use your Personal Data or data only as necessary to provide these services to us. In such cases Leadmark will ensure that such, service providers and business partners comply with this Privacy Statement and adopt appropriate confidentiality and security measures.
We will obtain your prior explicit consent before we share your Personal Data or data to any person outside Leadmark for any purpose that is not directly connected with providing our Services to you. We will share your Personal Data with third parties only in the ways that are described in this Privacy Statement. Your Personal Information will not be sold to or otherwise provided to third parties for purposes of marketing their goods or services.
Please be aware that European or Dutch laws may obligate us to disclose user information and the contents of your user account to the local law enforcement authorities under a legal process or an enforceable government request. In addition, we may also disclose Personal Information and contents of your user account to law enforcement authorities if such disclosure is determined to be necessary by Leadmark in our sole and absolute discretion for protecting the safety of our users, employees, or the general public. If Leadmark is involved in a merger, acquisition, or sale of all or a portion of its business or assets, you will be notified via email and/or a prominent notice on our website of any change in ownership or uses of your Personal Data, as well as any choices you may have regarding your Personal Data.
How secure is your information
Leadmark complies with all laws and regulations applicable to privacy and data protection. We adopt industry appropriate data collection, storage and processing practices and security measures, as well as physical security measures to protect against unauthorized access, alteration, disclosure or destruction of your Personal Data, username, password and transaction information. Access to your information is restricted to those who need to know such information in connection with providing the Services to you and are bound by confidentiality obligations. Backups of the information stored in your account are scheduled on a regular basis and these backups are stored and safely locked up.
Your choice in information use
From time to time, we may send emails or newletters to you regarding new services, releases and upcoming events. You may opt out of receiving newsletters and other secondary messages from Leadmark by selecting the ‘unsubscribe’ function present in every email we send. However, you will not be able to opt out from receiving essential service announcements and administrative messages.
Your Personal Data Rights
Upon request, we will provide you with information about whether we hold any of your Personal Data. This gives you the opportunity to correct, update or remove your Personal Data from our database(s), to not receive future communications or to no longer receive our service. Users who whish to correct, update or remove any Personal Data from TRAC, can access the system at any time and undertake the actions they deem necessary. Users who wish to correct, update or remove any Personal Data including those from a public forum, directory or testimonial on our site may do so either by contacting Leadmark at info@leadmark.nl. We will respond to your request to exercise these rights without delay and within 10 working days.
Investigation of illegal activity
We may need to provide access to your Personal Data and related information to our employees and service providers for the purpose of investigating any suspected illegal activity or potential violation of the terms and conditions for use of Leadmark Services. However, Leadmark will ensure that such access is in compliance with this Privacy Statement and subject to appropriate confidentiality and security measures.
Enforcement of privacy Statement
We make every effort, including periodic reviews to ensure that Personal Data provided by you is used in conformity with this Privacy Statement. We will contact you to address your concerns and we will also co-operate with regulatory authorities in this regard if needed.
Notification of changes
We may modify the Privacy Statement upon notice to you at any time through a service announcement or by sending email to your primary email address. If we make significant changes in the Privacy Statement that affect your rights, you will be provided with at least 30 days advance notice of the changes by email to your primary email address. You may terminate your use of Leadmark Services by providing Leadmark notice by email within 30 days of being notified of the availability of the modified Privacy Statement if the Privacy Statement is modified in a manner that substantially affects your rights in connection with use of Leadmark Services. Your continued use of Leadmark Services after the effective date of any change to the Privacy Statement will be deemed to be your agreement to the modified Privacy Statement. You will not receive email notification of minor changes to the Privacy Statement.
